Davaco data breach $540K class action settlement – Top Class Actions




Davaco agreed to pay $540,000 to resolve claims surrounding a 2021 data breach that compromised sensitive personal information.
The settlement benefits consumers who received a notice that their information may have been compromised in the 2021 Davaco data breach.
Davaco is a project-management firm that assists its clients in developing and maintaining projects. The company has reportedly provided services to brands such as Target, Sephora, Home Depot, Starbucks and more.
According to a class action lawsuit, Davaco failed to protect employee data from third parties — resulting in a ransomware data breach in June 2021. The breach allegedly compromised sensitive employee information, including names, Social Security numbers and identification card numbers. 
Plaintiffs in the data breach class action lawsuit contend that Davaco could have prevented the incident through reasonable cybersecurity measures and better employee training. By failing to do so, Davaco allegedly placed current and former employees at risk for fraud for years to come.
“The ramifications of Defendant’s failure to keep Plaintiff’ [sic] and Class Employees’ Sensitive Information secure are long lasting and severe,” the Davaco data breach class action lawsuit argues. “Once Sensitive Information is stolen, fraudulent use of that information and damage to victims may continue for years.”
Davaco hasn’t admitted any wrongdoing but agreed to a $540,000 class action settlement to resolve these claims.
The settlement provides a number of benefits including cash payments and/or free credit monitoring, based on class member experiences. 
All class members can choose to receive a basic award of $185 or 36 months of free identity theft protection through Pango’s Financial Shield. Class members who lived in California as of June 11, 2021, can also claim a payment of $175. 
The settlement also provides reimbursement. 
Class members can claim reimbursement for up to five hours of lost time at a rate of $20 per hour. Class members who suffered unauthorized charges, monetary losses, fraud and other out-of-pocket expenses can claim up to $5,000 in reimbursement for these losses.
Cash payments from the settlement may be increased or decreased on a proportional basis depending on the number of claims filed. Any funds remaining in the settlement after payment distributions will be donated to a charitable organization.
The deadline for exclusion and objection is Nov. 28, 2022. 
The final approval hearing for the settlement is scheduled for Feb. 13, 2023. 
In order to receive benefits from the Davaco data breach settlement, class members must submit a valid claim form by Jan. 12, 2023.
